PRIVACY NOTICE FOR REGISTRANTS OF SEC EMPLOYEE SERVICES

The SECURITIES AND EXCHANGE COMMISSION (SEC) is committed to protect and respect your personal data privacy. We are at the forefront of not only implementing but also complying with the Data Privacy Act of 2012 (RA No. 10173), and pertinent issuances of the National Privacy Commission (NPC).

1. WHAT PERSONAL INFORMATION WE COLLECT?

In the course of providing various employee services, the Employee Services Unit of the Human Resources Management Division, Human Resources Department, collects the following information from SEC personnel:

 • Personal details such as name, contact details, date of birth, gender, nationality, civil status, family background, and other similar information;
 • Employment information such as employment history, position, compensation and benefits, attendance records, and other related information;
 • Educational information such as educational background, professional qualifications, and certifications;
 • Financial information such as tax identification number (TIN), bank account details, and other financial information relevant to employment;
 • Government-issued identification numbers such as GSIS ID number, Pag-IBIG ID number, PhilHealth ID number, and SSS ID number; and
 • Beneficiary and dependent information such as their names, dates of birth, relationship to the employee, and contact details, to administer employee benefits and plans.
 • In limited circumstances, we may collect health information for processing of leave of absence requiring supporting documents for verification, benefits claims, or information relating to grievance and administrative cases.

2. HOW WE COLLECT

We collect, use, and process personal information from electronic and paper documents submitted by employees, such as application forms, employment documents, or other requests, as well as through their use of the Human Resources Management Information System (HRMIS).

3. WHY WE COLLECT

The collected information is used to:

 • Implement the HRMIS;
 • Manage employee development;
 • Manage 201 files and employment records;
 • Comply with legal and regulatory requirements;
 • Investigate and address employee grievances and disciplinary actions;
 • Administer and provide employee benefits, including welfare and loan programs;
 • Update records with other government agencies such as the GSIS, PhilHealth, and Pag-IBIG;
 • Process requests for employment certificates, travel authority, and other employee services; and
 • Ensure full compliance with employment-related laws and regulations in the government sector.

4. HOW WE KEEP YOUR PERSONAL INFORMATION SECURE

We implement appropriate physical, technical, and organizational safeguards to ensure the confidentiality, integrity, and availability of personal information. Only authorized SEC personnel are granted access to the personal information collected through the HRMIS. The collected personal information is stored in a secured database. We use reasonable security safeguards to protect the information gathered from any loss, unauthorized access, use or disclosure.

5. RIGHTS OF THE DATA SUBJECT

Under the Data Privacy Act of 2012, data subject refers to an individual whose personal information is collected and processed. SEC is duly bound to observe and respect your privacy rights, including your right to information, right to access, right to correct, right to remove, right to damages and right to data portability.
